La Sala Constitucional hoy declaró con lugar el recurso de amparo Nº23-0020233-0007-CO interpuesto por un ciudadano, a favor suyo y de sus nietas, contra la disposición del Ministerio de Salud (circular NºMS-DRPIS-UR-1588-2023, 22 – junio – 2023) que ordenó ocultar el etiquetado frontal de alimentos, llamada también EFAN (Etiquetado Frontal de Advertencia Nutricional).
El EFAN advierte sobre excesos en azúcares, grasas, sodio (sal) y otros nutrientes críticos, relacionados con enfermedades no trasmisibles (ENT) como hipertensión y diabetes.
Los magistrados de la Sala IV indicaron que el Ministerio de Salud contravino el derecho a la salud y el derecho de las personas de contar con información clara y de fácil comprensión al adquirir alimentos que pueden tener un impacto relevante para su salud. Esta es información nutricional complementaria, aseguran no contradice el Reglamento Técnico Centroamericano (RTCA) en lo que respecta a facilitar al consumidor la comprensión de la información relacionada con el valor nutritivo del producto. Indicaron también que es inaceptable que, con el argumento de la falta de uniformidad en el etiquetado de productos y las dudas sobre la forma de implementarlo, se optara por ocultarlo.
Para la Asociación Costa Rica Saludable, el haber obligado a tapar los sellos EFAN fue un retroceso y ahora Costa Rica debe más bien aprobar el proyecto de ley Nº23861.
